WHEATHER MALAWI SHOULD LEGALISE SAME SEX MARRIAGES OR NOT
Same sex marriages have been a controversial issue worldwide likewise in Malawi. Civil societies, Non-Governmental organizations and government have been debating about this hot issue. What are same sex marriages? These are marriages practiced by partners of the same sex. Although some parties are saying that same sex marriages should be legalized because it is being considered as civil rights (R. Bowe, 2004). There are a number of reasons that same sex marriages should not be legalized in Malawi because same sex marriages may be at higher risk of contracting Sexual Transmitted Disease, it is also immoral and against our culture to practice same sex marriages, it is against the Laws of Malawi, it as well offend God and it we should as well understand that marriage is the foundation of procreation.
Firstly, same sex marriages may be at higher risk of contracting Sexual Transmitted Diseases and many other diseases. British researcher found that anal sex contributes much of the sexual transmitted diseases. The rectum is significantly different from the vagina with regard to the suitability for penetration by penis. The vagina has natural lubricants and is supported by the network of muscles; it is composed with mucus membrane with a malt layer stratified squalors epithelium that allows it to endure friction without damage and resist the immunological actions caused by semen and sperm. In comparison the anus is delicate mechanism of small muscles that comprise an “exit only” passage, with repeated friction and stretching the sphincter lose its tone and its ability to maintain tight seal. Anal intercourse leads to leakage of fecal material that can easily become chronic. The end result is that the fragility of the anus and rectum, along with the immunosuppressive effect of ejaculation, make anal genital intercourse most efficient manner of transmitting HIV and other infectious diseases. Here are examples of some of the diseases as results of anal intercourse are anal cancer, syphilis, HIV/AIDS, human papilloma virus, chlamydya etc.
Secondly, same sex marriage is immoral and against our culture. Even some Non governmental organizations, for instance, Center for the Development of People(CEDEP) directed by Gift Trapence defended gays that they as well have rights to marry who so ever they want to marry. Although some NGO’s are pursuing government to legalize same sex marriages, but Malawians should remember that our country is called ‘the warm heart of Africa’ just because we are well known as having good morals and we preserve culture. The former President of Malawi Dr Bingu Wa Mutharika describe gays as “worse than dogs”.(J. Moyo 2011). The Malawi Council of Churches (a grouping of pastors up to 22 protestant churches) advised government of Malawi to maintain laws that criminalize same sexual acts and asked international organizations to refrain from using aid as a means of forcing Malawians to legalize the immoral acts of same sex marriages.
Thirdly, it is against the laws of Malawi to practice same sex marriages. Although everyone have got right to marry who ever he/she wants, or can practice homosexual in private (Gift Trapence) but because of the Penal Code provides in section 137A; indecent practices between females and it states that; any female person who whether in public or private commits any act of gross indecency with another female person or procures another female person to commit any act of gross indecency with her or attempts to procure the commission of any such act by any female person with herself or with another female person whether in private or public, shall be guilty of an offence and shall be liable to imprisonment for five years. In addition, section 153 of the Penal Code it is talking about unnatural offences and it reads; any person who (a) has carnal knowledge of any person against the order of nature or (c) permits a male person to have carnal knowledge of him or her against the order of nature, shall be guilty of a felony and shall be liable to imprisonment for fourteen years with or without corporal punishment. Lastly, section 156 of the Penal Code is talking about indecent practices between males and it states that any male person who whether in public or private commits any act of gross indecency with another male person or procures another male person to commit any act of gross indecency with him or attempts to procure the commission of any such act by any male with himself or with another male person whether in public or private shall be guilty of felony and shall be liable to imprisonment for five years. One can clearly see here that our Penal Code bars this practice of marrying a partner of the same sex and this is why Tionge Chimbalanga and Steve Monjeza was arrested in 2011.
Fourthly, same sex marriages offend God. In Malawi there are few people who doesnt believe in God of which if they are to practice same sex marriages, they will see as if they are offending nobody. Although the minority of Malawians does not believe in God, the majority believes in God and they belong in various religious groupings be it Christians or Muslims. In Genesis 2:24, the Bible reads that “a man shall leave his farther and mother and be joined to his wife and shall become one flesh”. Likewise, Quran 4:1 reads that “Lord created countless men and women who are to marry each other”. So one can Cleary see that God created a man to marry a woman but gays/lesbians do the opposite. God destroyed Sodom and Gomorah just because they were practicing homosexual (Genesis 19:24-25). Quran 7:81 bars same sex marriages and describe it as “worse than adultery or any other sexual sin”. Malawians can choose what is good or bad because both Christians and Muslims condemn same sex marriages since it offends God.
Furthermore, marriage is the foundation of procreation. Procreation means “to generate offspring’s” (Dictionary.com). Although gays/lesbians may have children by means of adoption or use of surrogates, they may not be able to produce offspring’s own their own because naturally a man cannot impregnate a man and a woman impregnate a woman respectively. Traditionally, the primary purpose that marriage serves is to secure a mother and fathers who are expected to produce offspring’s so that the generation continues. For example, in Canada, Netherland and Sweden they are having law fertility rate just because they are highly practicing same sex marriages (Bidstrupt, Scott 2003).
Lastly, same sex marriages violate natural law. Gays/lesbians may enjoy sexual intercourse as every one may enjoy. But naturally, a man is supposed to sleep with a woman. Even in the animal kingdom which has approximately 1500 species, a male animal will usually look for a female animal for mating (B. Bahemihl, 2000). If the animal that doesn’t properly think is doing what is naturally correct, what more a human being who has got all the five senses?
In conclusion, same sex marriages should not be legalized in Malawi much as our moral standards are concerned. Since gay marriages contribute to the transmission of HIV/AIDS, our hospitals are not worth enough to give medicine (ARVs) to patients who are suffering from this epidemic disease since our budget do not depend on donor support as a result they are daily dying there by leaving relatives helpless. Finally, Malawians should learn to respect our Laws that are clearly disallowing any unnatural act. We shouldn’t be deceived by European cultures.
